❌ Unsubstantiated Reasons for Enacting the Moratorium.


🚱 No Study, Analysis, or Data Gathering by the City Indicating a Greater Burden on Water Withdrawal or Infrastructure for Short-Term Vacation Rentals Compared to Other Property Uses.


🛑 Absence of Studies Demonstrating the Adverse Impact of Vacation Rental Property Loss on Local Businesses, Groceries, and Stores.
 

🔄 Lack of Ongoing Studies Analyzing the Effects of Short-Term Vacation Rentals on Zoning, Public Safety, and Other Factors Affecting the Health, Safety, and Welfare of Tybee Island’s Citizens and Visitors.



Constitutional Concerns

🚫 Violation of Constitutional Rights to Equal Protection and Due Process for Citizens Seeking Business Licenses and Registering Property for Short-Term Vacation Rentals.


🔄 Unconstitutional Infringement on Vested Rights of Individuals Who Have Invested in Property with the Intention of Using It as a Short-Term Vacation Rental Under the Current Regulatory Scheme.

If you sell your property, it would immediately terminate your rights to rent.

🔄 LLC Restructuring Triggers Immediate Termination:

Any restructuring of your LLC, including a change in the percentage of ownership, will result in an immediate termination of your rental certificate.

🔄 Retitling to Spouse, Family, or Upon Death:

Retitling the property to a spouse, family member, or anyone upon death will also lead to an immediate termination of your rental certificate.

🏛️ Property Trust Results in Termination:

Placing your property into a trust will terminate your rights to rent.

The moratorium has ENDED an only those with licenses in place can currently continue to rent unless they are owner occupied. As a Tybee resident, property owner and Realtor of 18+ years involved in property management, individual property rights are always a priority.
